A Delhi file usually begins with a folder rather than a question. The client arrives with a lease deed, a conversion receipt and a set of bank statements. There is also a property everyone agrees is worth far more than the paperwork says. Sorting what is owned from what is merely held is the first task, and it is not always a short one. The general treatment sits in our note on proving what you own.

The second task is choosing a basis and saying so. Two defensible figures exist for the same Delhi property, and they are a long way apart. A statement that does not name the one it used invites the reader to assume the other. Saying which basis was applied costs a line and settles the point. Land and housing records for the capital are held by the development authority.

What Ownership Means on a Delhi Statement

Title in the capital comes in grades that are not interchangeable. A large part of the city's housing was allotted on a ninety-nine year lease. Until freehold conversion completes, the owner holds a perpetual lease deed rather than a conveyance deed. A net worth certificate in Delhi records what a person owns and owes on a stated date. It has to describe the grade of interest rather than flatten it into ownership.

Value is the second thing stated rather than assumed. The government's minimum for registration and a registered valuer's opinion are both defensible and sit a long way apart. A net worth certificate in Delhi therefore names the basis it used, because a reader who assumes the other will read the total wrongly. An interest held on an attorney and a will is described as the interest it is. Conversion charges may still be running in instalments when the certificate is drawn.

  • Delhi sub-registrarRegistration here is organised by revenue district and each district has its own sub-registrar. A property in Rohini is registered in the North West district and one in Saket in the South, so a search follows the property rather than the owner's address. The registered deed and the office record are matched before a property entry is written.
  • DDAA large part of the city's housing was allotted by the Delhi Development Authority on a ninety-nine year lease. Until a flat is converted, the paper in the owner's hands is a perpetual lease deed and not a conveyance deed. The conveyance deed issues only once conversion is complete and dues are cleared. Conversion charges may be paid in one sum or in instalments across five years, which leaves plenty of owners part way through.
  • NCR bank branchesA Delhi borrower's file is often assessed against security standing in a different state, because the capital region runs across three of them. Naming the state in which each property is registered removes a question the reader would otherwise raise.
  • Patiala House and Saket courtsBoth take filings in which a party's worth is in issue, and a court reads the statement as a disclosure rather than as support for an application. The wording that satisfies a lender does not satisfy a court, and the difference lies in what is said about completeness.

  • DDA and freehold property recordsDelhi values property against a number that has not moved in over a decade. Residential and commercial circle rates were last revised in 2014 and agricultural rates in 2008. A committee under the Divisional Commissioner has been reviewing them since the middle of 2025, with a band above category A and a finer classification under discussion, and nothing has been notified. Which of the eight categories a colony falls in decides the rate, and the categories themselves have not been redrawn either. A statement drawn only at circle rate can therefore understate a South Delhi or Dwarka property by a wide margin.
  • Two figures rather than oneThat gap is why a Delhi file often carries two bases. The circle rate is the government's minimum for registration and is easy to evidence. A registered valuer's opinion is closer to what the property would fetch and is what a lender assessing security actually wants. Which basis has been used belongs on the face of the statement, because a reader assuming the other one will read the total wrongly. A lender will sometimes take the circle rate for a property comfortably clear of the amount it is securing, and insist on a valuer's report for one that is not. Asking which the reader wants before the work starts saves redrawing the statement.
  • Describing the interest preciselyTitle in the city has to be described precisely rather than loosely. A leasehold DDA flat, a converted freehold flat and a builder floor on a freehold plot are three different things and the paper behind each is different. Where a property is held on a general power of attorney, an agreement to sell and a will, it is not owned in the sense a certificate asserts. No amount of drafting makes it so. The honest treatment describes the interest held and leaves the reader to weigh it.
  • Delhi court filingsCourt files ask for something the banking files do not. A statement filed at Patiala House or Saket is read for what it leaves out as much as for what it contains. An omitted account or an undisclosed interest therefore costs more than an imprecise valuation. The management representation behind the statement matters here, because it records what the party said and what was not independently verified.

What an Unevidenced Delhi Valuation Costs

A Circle Rate Understates the House

The official minimum has not moved in over a decade while the market has. A statement built only on that figure can show a fraction of what a Delhi property would fetch. A lender assessing security then reads the shortfall as the client's whole position.

Leasehold Presented as Ownership

A flat still held on lease from the authority is not the same asset as a converted one. Describing it as owned outright is a claim the conveyance deed does not support, and it is a claim any reader can check in an afternoon.

A Power of Attorney Treated as Title

Property held on an attorney, an agreement and a will is not owned in the sense a certificate asserts. Including it at full value puts the weakest item in the file at the very centre of the total.

If the certificate is going to a bank assessing security, get the valuer's report; the circle rate will not carry it. If it is going to a court or an authority that only needs a position stated, the circle rate is adequate and the report is money spent for nothing.

Is a DDA leasehold flat treated differently from a freehold one?

The asset is included either way, but the tenure is disclosed. A Delhi Development Authority leasehold property is held under a perpetual lease with conditions on transfer and mutation, while a converted freehold property is held absolutely. Lenders price the two differently, so the certificate names the tenure rather than leaving it to be discovered.

Does a property bought on general power of attorney count as owned?

No. The Supreme Court held in Suraj Lamp and Industries v. State of Haryana that transactions through a general power of attorney, will and agreement to sell do not convey title. That affects a large stock of older Delhi transactions. Such a holding is disclosed as a possessory interest, not as an owned immovable asset.

What proves ownership in a regularised unauthorised colony?

The registration papers issued under the regularisation scheme. Delhi's framework for conferring rights in unauthorised colonies allows conveyance or authorisation slips to be registered, and that registered document is what the certificate rests on. Possession, electricity bills and colony association letters corroborate but do not substitute for it.

Does a Delhi court filing require the certificate to be on affidavit?

The party swears the disclosure on affidavit and files the chartered accountant's certificate as an annexure to it. Filings at Patiala House, Saket and the other district court complexes follow that pattern, so the certificate is prepared knowing it will be exhibited. The affidavit is sworn by the litigant; the certificate is signed by the member.

Is a pending freehold conversion disclosed?

Yes. Where a conversion application is lodged with the DDA but not concluded, the property is still held on lease and the certificate says so. Buyers, lenders and courts treat a completed conversion as materially different. So recording the application as pending is what keeps the certificate accurate on the date it speaks from.

Is a DDA allotment letter enough without a conveyance deed?

Not by itself. An allotment letter records that the authority has allotted the property and usually precedes possession and execution of the conveyance or lease deed. The certificate reflects amounts paid against the allotment until the deed is executed and registered, at which point the property enters the schedule as an owned asset.

How is a property in an NCR town handled when the lending branch is in Delhi?

The evidence follows the property, not the branch. A flat in Noida or Ghaziabad is verified against that district's sub-registrar record and the authority's allotment file. The certificate is still submitted to the Delhi branch. Branches usually run their own search in the property's jurisdiction before sanction.

Does the Delhi circle rate determine the certified value?

It determines the minimum value for stamp duty on a transfer. Circle rates are notified by the Delhi government by locality and category, and in several colonies the market price diverges sharply from them. A certificate on a market basis needs a valuer's report; one on a circle rate basis says so explicitly.

Are lal dora properties in Delhi villages includable?

They are disclosed with their basis. Title in the abadi area of a Delhi village is often evidenced by revenue records and possession rather than a registered conveyance. The certificate states what the holding rests on. Lenders vary widely in what they will accept against such a property, so the disclosure matters more than the figure.

Is a builder floor with an undivided share of land one asset or two?

One, described accurately. A Delhi builder floor typically conveys the constructed floor together with a proportionate undivided interest in the land, and the sale deed says so. The schedule reflects that single holding with the undivided share stated, since splitting it into land and structure suggests two saleable assets where there is one.
