What Is Copyright for Sound Recording?

Copyright for sound recording is a legal right under the Copyright Act, 1957 that grants the owner exclusive control over the reproduction, distribution and public communication of a recorded audio work in India.

Under Section 2(xx), a sound recording means a recording of sounds from which such sounds may be produced, regardless of the medium on which it is recorded or the method by which the sounds are produced. This covers songs, music albums, podcast episodes, audiobooks, spoken-word recordings, background scores and any other audio content captured in a tangible format.

Under Section 13(4), the copyright in a sound recording does not affect the separate copyright that may exist in the literary, dramatic or musical work from which the recording is made. This means multiple copyrights can co-exist in a single song - one for the lyrics, one for the composition and one for the sound recording itself. The key rights conferred under Section 14(e) include making copies, selling or renting copies, and communicating the recording to the public.
