What Is a Section 281 Certificate

Definition: It is a No Objection Certificate, or prior permission, issued by the transferor's jurisdictional Assessing Officer under Section 281 of the Income-tax Act, 1961, allowing the transfer of an asset that would otherwise be void against pending tax claims.

Under Section 281, if an assessee creates a charge or parts with possession of any asset - by sale, mortgage, gift, exchange, or any other transfer - during the pendency of any proceeding under the Act, or after completion but before notice under the Second Schedule, the transfer is void against any tax or sum payable.
