    The short version

    1. The scheme window was extended by three months, from 30 September 2026 to 31 December 2026.
    2. The extension is on the same terms and conditions as before.
    3. Court cases filed up to 31 March 2025 are eligible.
    4. Ad-hoc assessments can be settled by paying actual contributions and interest, with no damages.
    5. Cases already paid up can be withdrawn by paying 10% of the disputed damages.

    In short

ESIC, the Employees' State Insurance Corporation, is giving employers and insured persons more time to settle disputes out of court. The Ministry of Labour & Employment announced this in a press release posted on 29 October 2026. The scheme is a one-time route to clear old ESI disputes and court cases.

    What has changed

    How it worked before

The New Amnesty Scheme 2025 ran from 1 October 2025 to 30 September 2026. Employers with ESIC disputes had until that date to apply.

    What has changed

The deadline has moved from 30 September 2026 to 31 December 2026. The rules and the settlement terms are unchanged.

    Who this affects

Employers registered under ESIC with a pending dispute or court case filed by ESIC up to 31 March 2025. Insured persons, meaning employees covered by ESI, with pending cases are also included.

    An example

A small garment unit in Surat received an ad-hoc assessment from ESIC and has not yet paid. Under the scheme, it can settle by paying the actual contributions and interest, and no damages will be charged. If the unit had already paid the dues and was still in court, it could withdraw the case by paying 10% of the disputed damages.

    What you should do

If you have an ESIC dispute or court case, check whether it was filed up to 31 March 2025 and apply under the scheme before 31 December 2026. The full scheme details are in the ESIC flyer linked in the press release.

    If you do nothing

The release does not say what happens to cases that are not settled under the scheme after 31 December 2026. It only states that the window closes on that date. Employers with open disputes should not assume the scheme will be extended again.

    The terms explained

    New Amnesty Scheme 2025
A one-time ESIC scheme that lets employers settle old disputes and court cases out of court, with reduced costs.
    ad-hoc assessment

    insured person
An employee who is covered by ESI, the health and cash benefit scheme run by ESIC.

Does the ESIC amnesty scheme apply to me?

It applies if you are an employer with an ESIC dispute or a court case filed by ESIC up to 31 March 2025. Insured persons with pending cases are also included. If your case was filed after that date, the release says it is not covered.

What is the new deadline for the ESIC amnesty scheme?

The scheme now closes on 31 December 2026. The earlier deadline was 30 September 2026.

Will I have to pay damages if I settle under the scheme?

For ad-hoc assessments, no damages will be charged. You pay the actual contributions and interest. For cases where you have already paid the dues, you pay 10% of the disputed damages to withdraw the case.

Are the terms of the scheme different after the extension?

No. ESIC extended the window on existing terms and conditions, so the settlement rules are the same as before.
