📌 TL;DR - Copyright for Artistic Work Services at a Glance

Under Section 2(c) of the Copyright Act, 1957, 'artistic work' includes paintings, sculptures, drawings, engravings, photographs, works of architecture, and any other work of artistic craftsmanship - whether or not the work possesses artistic quality. Copyright is automatic upon creation, but formal registration with the Copyright Office under Section 45 provides prima facie evidence of ownership in court. Registration fee is Rs 500 per artistic work. Copyright lasts for 60 years from the year following the author's death (Section 22), or 60 years from publication for photographs (Section 25).

Patron Accounting assists artists, photographers, architects, and designers with end-to-end copyright registration from offices in Pune, Mumbai, Delhi, and Gurugram. Whether you are protecting a single painting or registering an entire portfolio, our CA and CS team ensures compliance with the Copyright Act, 1957 and Copyright Rules, 2013.

What Is Copyright for Artistic Work?

Copyright for artistic work is the exclusive legal right granted to the creator of an original artistic work - as defined in Section 2(c) of the Copyright Act, 1957 - to reproduce, distribute, display, and adapt the work, and to authorise others to do the same.

Section 2(c) defines 'artistic work' as: (i) a painting, a sculpture, a drawing (including a diagram, map, chart, or plan), an engraving, or a photograph, whether or not any such work possesses artistic quality; (ii) a work of architecture as defined in Section 2(b) - any building or structure having an artistic character or design; and (iii) any other work of artistic craftsmanship. The phrase 'whether or not any such work possesses artistic quality' means even simple functional drawings, basic photographs, or rudimentary sketches qualify for copyright protection if they are original.

The intersection with the Designs Act, 2000 is governed by Section 15 - if an artistic work is registered as a design, its copyright protection ceases; if capable of being registered as a design but not registered, copyright ceases once the work is reproduced more than 50 times by an industrial process.

Key Terms for Copyright for Artistic Work:

Artistic Work (Section 2(c)) - Includes paintings, sculptures, drawings, engravings, photographs, works of architecture, and any other work of artistic craftsmanship - regardless of artistic quality.

Work of Architecture (Section 2(b)) - Any building or structure having an artistic character or design, or any model for such building or structure.

Photograph - An original photograph taken by any process. Each photograph is a separate work. Copyright lasts 60 years from publication (Section 25).

Section 15 (Copyright vs Design) - If an artistic work is applied industrially (reproduced more than 50 times), copyright protection ceases. Choose between copyright and design registration for industrially applied works.

Who Should Register Copyright for Artistic Work?

  • Painters and Illustrators: Traditional and digital painters, illustrators, and visual artists seeking legal proof of ownership for original paintings, sketches, and illustrations
  • Sculptors and Installation Artists: Creators of three-dimensional works including statues, carvings, moldings, and art installations. Photographs of sculptures are treated as separate works
  • Photographers: Professional and amateur photographers - each original photograph qualifies as a separate artistic work under Section 2(c). Wedding, commercial, editorial, and fine art photographers should register key works
  • Graphic Designers and Digital Artists: Creators of logos, infographics, digital illustrations, UI/UX designs, and NFT artwork. Note: logos may also qualify for trademark registration
  • Architects: Architectural designs, building plans, and structural models with artistic character are protected under Section 2(b). The building must be located in India per Section 13(2)(iii)
  • Art Galleries and Publishers: Entities holding collections of artistic works should register copyright to establish clear ownership records for exhibition, licensing, and sale

Frequently Asked Questions - Artistic Work Copyright

Expert answers to the most common questions about copyright registration for paintings, sculptures, photographs, and other artistic works in India.

Quick Answers

Is copyright registration mandatory? No. Copyright is automatic upon creation. But registration provides prima facie evidence (Section 48) essential for enforcement.

Can AI-generated art be copyrighted? Under current Indian law, the 'person who causes the work to be created' is the author. Purely AI-generated works without human creative input face uncertain copyright status.

Can I copyright a tattoo design? Yes, if the design is original. Tattoo designs qualify as artistic work under Section 2(c).

Are art reproductions (prints) protected? Prints of an original work are protected. However, mass industrial reproduction (50+ times) may trigger Section 15(2) design registration requirements.

Protect Your Artistic Work Today

Every day your artistic work remains unregistered is a day you lack prima facie evidence of ownership. Without registration, enforcing your rights through civil remedies (Section 55) or criminal proceedings (Section 63) becomes practically impossible. Artists, photographers, and designers face increasing risks of unauthorised reproduction in the digital age.

Don't wait for infringement to happen. Call +91 945 945 6700 or WhatsApp us to start your copyright registration today. Starting from Rs 3,500 per work.
