Overview of Real Estate Developer Payroll Services

📌 TL;DR - Real Estate Payroll Services at a Glance

If you are a RERA-registered developer running multiple projects with a mix of corporate staff, project-level engineers, in-house brokers and contract masons, your payroll needs CA-led handling. Patron allocates payroll project-by-project per RERA registration, processes broker 194H batches at 2 percent, runs CLRA quarterly reconciliation, and ties workforce data to RERA quarterly disclosures. Starting Rs 149 per employee per month.

Real estate developer payroll is a multi-statute compliance surface organised around RERA project accounting. Under Section 4 of the Real Estate (Regulation and Development) Act 2016, every promoter must deposit at least 70 percent of buyer monies into a separate project escrow account that can only be used for construction and land-related expenses. That single rule rewires payroll: every project-attributable wage (site engineer, project manager, RCC supervisor, captive labour) must be cost-segregated between the escrow project account and the corporate overhead account - because routing corporate payroll through escrow is a Section 4 violation, and treating project-staff salary as corporate overhead understates the project cost and overstates corporate income.

Layered on this are Section 11 quarterly project disclosures to the State RERA Authority (which require workforce and expenditure data tying back to payroll), Section 194H brokerage TDS at 2 percent (reduced from 5 percent effective 1 October 2024 per Finance Act 2024) on commissions paid to in-house sales agents and external channel partners, CLRA principal-employer liability for contract masons, carpenters and site engineers under contractors, BoCW welfare cess at 1 percent on cost of construction, and Code on Wages 50 percent basic rule from 21 November 2025. Patron Accounting LLP runs all of this as a managed service starting from Rs 149 per employee per month.

Content is reviewed quarterly for accuracy.

What Is Real Estate Developer Payroll Processing

Real estate developer payroll processing is the monthly computation, statutory withholding, project-wise cost allocation and RERA-aligned reporting of compensation paid by a real estate promoter to its corporate staff, project-level engineers and site managers, in-house sales executives and brokers, and any contract labour deployed at project sites. Deliverables include salary disbursement, Section 192 (Section 392 from FY 2026-27) salary TDS, EPF and ESI contributions on the Code on Wages base, Section 194H broker TDS at 2 percent in a separate non-salary batch, project-wise wage cost segregation between the RERA escrow project account and corporate overhead, BoCW cess where captive construction applies, and quarterly Form 24Q and Form 26Q on TRACES.

What makes real estate developer payroll different from a generic corporate payroll is the project-wise allocation requirement under RERA Section 4. A developer running three projects (a 4-tower residential complex in Pune, a commercial office in Mumbai, a township in Hyderabad) cannot route a single payroll batch through the corporate account; each project's site engineer, project manager, RCC supervisor and dedicated administrative staff must have their wages charged to the respective project escrow account. The 70 percent escrow rule means buyer monies sit in the project account and can only be released for construction and land costs - which includes project-attributable wages. Misallocation triggers RERA Section 59 penalty up to 5 percent of project cost.

Section 194H is the second axis. Real estate is a brokerage-heavy industry. In-house sales executives often draw a fixed salary plus variable commission; external channel partners (RE agents) bill on closed transactions. Effective 1 October 2024, Section 194H TDS rate was reduced from 5 percent to 2 percent per Finance Act 2024; effective 1 April 2025, the threshold per FY per payee was raised from Rs 15,000 to Rs 20,000. The TDS is deducted at payment or credit, deposited by 7th of the next month, and reported quarterly via Form 26Q (Form 139 from FY 2026-27). Mixing this with Section 192 salary TDS in a single batch is a classification error that triggers EPFO 7A and Income Tax notices.

Patron Accounting LLP runs the entire real estate developer payroll compliance perimeter as a managed service. Our CA-led pod handles corporate staff salary, project-wise wage allocation per RERA registration number, in-house sales executive payroll under Section 192, separate Section 194H broker batch at 2 percent, CLRA contractor reconciliation with construction-side overlap, BoCW cess where applicable, Code on Wages 50 percent basic restructure, multi-state PT and the RERA Section 11 quarterly disclosure data pack delivered by the 10th of next month - with cross-sell to /gst-returns, /gst-audit, /statutory-audit and /esic-registration delivering a single engagement letter across the full compliance perimeter.

Common Challenges in Real Estate Developer Payroll and How We Solve Them

      ChallengeImpactHow Patron Accounting Solves It
Corporate payroll routed through project escrow A developer routes the entire monthly payroll (including corporate finance and HR salaries) through a single project escrow account. RERA inspection flags this as a Section 4 violation; penalty under Section 59 up to 5 percent of project cost. Project-wise allocation engine that segregates corporate vs project-attributable wages at the time of disbursement; corporate salaries debit the corporate account, project salaries debit the respective project escrow; reconciliation trail for every cycle.
Broker payment misclassified as salary An external channel partner closing on commission is paid through the salary batch with Section 192 TDS at the executive's slab rate; this is a classification error - it should be Section 194H at 2 percent on commission. The mismatch surfaces in 26AS reconciliation and triggers an Income Tax notice. Broker and channel partner batch separated at onboarding; Section 194H at 2 percent on payments above Rs 20,000 per FY per payee; Form 16A / Form 131 quarterly; Form 26Q filed.
Section 194H rate not updated post 1 October 2024 A developer continues to deduct Section 194H TDS at 5 percent (pre-Finance Act 2024 rate) for the post-October 2024 period; brokers raise refund claims; Form 26AS reflects excess deductions; reconciliation burden. Rate cards updated post 1 October 2024 to 2 percent; threshold raised from Rs 15,000 to Rs 20,000 per FY per payee from 1 April 2025; quarterly TDS return reflects correct rate.
Contract mason agency PF default A masonry contractor deploys 45 workers at a Mumbai project for 5 months; fails to remit PF for 3 months. EPFO Section 7A summons the developer as principal employer to make good Rs 8.4 lakh plus damages under Section 14B; defence under construction-contractor liability does not stand because the developer is the registered principal employer. Quarterly contractor PF and ESIC challan reconciliation; agency billing in escrow for incomplete proof; reverse-charge MSA clauses recover default.
RERA Section 11 disclosure misses workforce data A developer's quarterly disclosure to MahaRERA omits workforce expenditure breakdown; State RERA Authority issues a deficiency notice; complaint risk from allottees. Project-wise workforce and wage expenditure data extracted automatically every quarter; disclosure-ready data pack delivered by 10th of next month; developer files by the state-prescribed deadline without scramble.

How is project-wise payroll allocated under RERA?

Under Section 4(2)(l)(D) of the RERA Act 2016, at least 70 percent of buyer monies must sit in a separate project escrow account that can only be used for construction and land-related expenses including project-attributable wages. This means a developer running multiple projects must segregate payroll at the time of disbursement - corporate staff salaries debit the corporate account, while project-attributable wages of site engineers, project managers and RCC supervisors debit the respective project escrow. Misallocation triggers Section 59 penalty up to 5 percent of project cost.

Does the 70 percent escrow rule restrict payroll costs?

No - the 70 percent escrow restricts the type of expense that can be drawn from the project account, not the total payroll. Construction and land-related expenses (including project-attributable wages of site engineers, project managers, RCC supervisors, dedicated project administrative staff and captive labour) can be drawn from the project escrow. Corporate overhead salaries (central finance, HR, marketing, legal, central procurement) must be paid from the corporate account. Patron's payroll engine bifurcates these automatically at the time of disbursement.

What is the brokerage TDS rate under Section 194H?

Section 194H TDS rate on commission and brokerage was reduced from 5 percent to 2 percent effective 1 October 2024 per the Finance Act 2024. The threshold per FY per payee was raised from Rs 15,000 to Rs 20,000 effective 1 April 2025. If PAN is not quoted, TDS rate is 20 percent. The TDS is deducted at the time of payment or credit, deposited by 7th of next month, and reported quarterly via Form 26Q (Form 139 from FY 2026-27). Annual certificate is Form 16A (Form 131 from FY 2026-27).

In-house sales executive ko commission Section 194H mein deduct karein ya 192 mein?

In-house sales executive jo company ke payroll pe hain aur salary plus variable commission lete hain, unka entire payment Section 192 (Section 392 from FY 2026-27) ke under salary TDS mein process hota hai - average slab rate pe. Section 194H 2 percent rate sirf external channel partner ya broker ke liye hai jo payroll pe nahi hain. Yeh classification galti karne se EPFO 7A aur Income Tax notice aata hai. Patron yeh classification onboarding pe sort karta hai apne CA pod ke through.

Are site engineers and project staff covered under CLRA?

Permanent site engineers and project managers on the developer's payroll are NOT under CLRA - they are direct employees. CLRA applies to contract masons, carpenters, electricians, plumbers, finishers and other workers deployed via licensed contractors. The developer must register as principal employer under Section 7 CLRA, issue Form V to each contractor, verify the contractor's licence (Form VI), and is liable under Section 21 for contractor wage and PF / ESI default. Patron runs CLRA contractor reconciliation quarterly with billing escrow on incomplete proof.

Code on Wages 50 percent basic ka builder CTC pe kya effect hai?

Code on Wages 2019, jo 21 November 2025 se laagu hai, basic wages ko total remuneration ka kam-se-kam 50 percent rakhne ka requirement hai. Real estate companies mein traditional CTC structure 25 to 35 percent basic plus HRA, conveyance, allowance, special allowance tha. Ab restructure karna padega. Iska assar: EPF base badhega (12 percent dono taraf), gratuity provision badhegi, project-cost loading mein wage component badhega - jo RERA Section 4 escrow account se debit hoga. Patron yeh restructure onboarding ke part mein deliver karta hai.

How is RERA quarterly disclosure linked to payroll records?

Section 11 of the RERA Act 2016 requires every promoter to file quarterly project status disclosure with the State RERA Authority - covering project completion percentage, sums received from allottees, expenditure incurred and workforce deployed. Payroll feeds the workforce headcount and project-attributable wage expenditure data into this disclosure. Each State RERA has its own form (MahaRERA Form 5, KRERA Quarterly Update, UP-RERA QPR) with state-specific deadlines (typically 15 to 30 days from quarter close). Patron extracts data by 10th of next month.

What is the BoCW cess on captive construction?

Under Section 3 of the BoCW Welfare Cess Act 1996, every employer undertaking building or other construction work pays a cess at 1 percent of the cost of construction (excluding land value) per Notification S.O. 2899 dated 26 September 1996. For a developer with captive construction in progress (a new tower, a clubhouse, a captive utility), the cess is due to the State BoCW Welfare Board within 30 days of completion. Delayed payment attracts interest at 2 percent per month under Section 8 and penalty up to the cess amount under Section 9.

Four Active Transitions Hitting Real Estate Developer Payroll Right Now

Four transitions hit real estate developer payroll at once. First, Section 194H TDS rate dropped from 5 percent to 2 percent effective 1 October 2024 and the threshold rose from Rs 15,000 to Rs 20,000 per FY per payee effective 1 April 2025 - over-deductions on broker payments since then are sitting as refund liabilities or 26AS mismatches. Second, the Code on Wages 2019 has been in force from 21 November 2025 - every CTC structure with basic below 50 percent of gross is accruing potential EPF, gratuity and project-cost-loading adjustments. Third, the December 2025 uniform wage definition under Code on Social Security 2020 has already expanded the PF and ESI base. Fourth, the Income Tax Act 2025 takes over from 1 April 2026 - Form 16 becomes Form 130, Form 24Q becomes Form 138, Form 16A becomes Form 131, Form 26Q becomes Form 139, Section 192 becomes Section 392, Section 194H becomes Section 195.
