Our trust had a community-specific clause in the deed that would have caused 80G rejection. Patron identified this in the eligibility review and helped us amend it before filing. Saved us months of back-and-forth with the PCIT.

80G Registration in Mumbai - Overview

📌 TL;DR - 80G Registration in Mumbai Services at a Glance

80G registration is the approval under Section 80G of the Income Tax Act 1961 that enables donors to claim a 50% tax deduction on donations made to your NGO. While 12A exempts the NGO's own income from tax, 80G incentivises donors - making your trust, society, or Section 8 company significantly more attractive to individual donors, HNIs, and corporates directing CSR funds. Since the Finance Act 2020 amendment, 80G approval is provisional for 5 years (Form 10A) and must be renewed via Form 10AB. In Mumbai, applications are processed by the PCIT (Exemptions) at Aayakar Bhavan, Churchgate.

What Is 80G Registration

80G registration is the approval granted by the Income Tax Department under Section 80G of the Income Tax Act 1961 that allows donors contributing to your NGO to claim a tax deduction of 50% of the donated amount from their taxable income. This deduction is subject to the limit of 10% of the donor's Adjusted Gross Total Income.

While 12A registration exempts the NGO itself from paying income tax on its surplus, 80G operates on the donor's side - it provides a financial incentive for individuals, companies, and HNIs to donate. When a donor contributes Rs 1,00,000 to an 80G-registered NGO, they can deduct Rs 50,000 from their taxable income (subject to the 10% AGI ceiling), effectively reducing their tax liability. This is available only under the old tax regime - donors opting for the new regime under Section 115BAC cannot claim 80G deductions.

The Finance Act 2020 fundamentally changed the 80G regime. Now, all new approvals are provisional for 5 years (via Form 10A) and must be renewed through Form 10AB. Additionally, from FY 2021-22, every 80G-registered NGO must file Form 10BD (Statement of Donations) and issue Form 10BE (Certificate of Donation) to each donor. The department cross-matches the donor's 80G claim with the NGO's Form 10BD data. Non-compliance with Form 10BD attracts a penalty of Rs 200/day (Section 234AG) and Rs 10,000 to Rs 1,00,000 under Section 271K.

Key Terms for 80G Registration in Mumbai:

Section 80G: Income Tax Act provision allowing donors 50% tax deduction on donations to approved charitable organisations.

Form 10A: Application for provisional 80G approval, filed online on incometax.gov.in, valid for 5 years.

Form 10BD: Annual Statement of Donations that every 80G NGO must file, reporting all donations received with donor PAN and details.

Form 10BE: Certificate of Donation issued to each donor, enabling them to claim 80G deduction in their ITR.

PCIT (Exemptions): Principal Commissioner of Income Tax (Exemptions) at Aayakar Bhavan, Churchgate - processes all 80G applications for Mumbai entities.

Who Needs 80G Registration in Mumbai

Every NGO in Mumbai that wants to attract tax-deductible donations from individuals and corporates needs 80G registration. This includes:

Charitable Trusts: Public charitable trusts registered under the Bombay Public Trusts Act 1950 with the Charity Commissioner at Worli - educational trusts, healthcare trusts, welfare trusts, community development trusts. Private or family trusts are NOT eligible.

  • Self-certified copy of registration certificate - Charity Commissioner (BPT Act trusts), Registrar of Societies, or RoC (Section 8 companies)

Mumbai-specific tip: The PCIT (Exemptions) Mumbai closely scrutinises whether the NGO's objects and activities exclusively benefit a specific religious community or caste - this is a ground for 80G rejection. For Mumbai's multi-community landscape, ensure the trust deed or MOA clearly states that charitable activities are open to all sections of society. Patron's CA team reviews this before filing.
