What is FSSAI State License?

The State Licensing Authority issues the FSSAI State License to medium-sized food businesses with an annual turnover between ₹ 12 Lakh and ₹ 20 crore operating within a particular state. The license is proof that the relevant business complies with all the required regulatory standards, including hygiene and food safety procedures. 

Additionally, the license has a 14-digit FSSAI registration number, which must be displayed on the following:

Eligibility Criteria for FSSAI State License

Following are the factors that Food Business Operators must require before applying for a State License: 

  • Annual Revenue: The annual revenue of the Food BO’s should range between ₹12 lakh to ₹20 crore
  • Scale of Operations: The business is carried out within a particular state.

Documents Required for FSSAI State License

To apply for the FSSAI State License, applicants must have all the prescribed documentation readily available. Documentation is a vital part of the application process. Therefore, any errors or incomplete documentation can delay the approval of your license. 

Required Documents

  • Form B (Application Form) must be duly filled out and signed in 2 copies by the authorized signatory.
  • Processing unit layout plan displaying operational area allocation and measurements in meters or square meters (if manufacturing only)
  • Details of Directors/Partners/Proprietor/Executive Members of Society/Trust with full address and contact details (mandatory for companies only)
  • Manufacturing and Processing Units are mandated to provide details of equipment and machinery, including the number, installed capacity, and horsepower.
  • Valid Id and Address Proof issued by the Government authority of the Proprietor / Partner / Authorized Signatory.
  • In the case of Manufacturers, a list of food categories/products to be manufactured shall be provided.
  • Provide an authorization letter mentioning the name and address of the primary responsible person and an alternate nominee, clearly stating their authority to assist officials in inspections, sample collections, packing, and dispatch.
  • Provide a Water Analysis Report from a recognized lab to use as an ingredient in food (for manufacturers).
  • Legal Documents of possession of premises ( Sale Deed / Rent Agreement/ Electricity Bill, etc.)
  • Provide Partnership Deed/ Affidavit of Proprietorship, Memorandum & Articles of Association (MOA), or incorporation certificate.
  • Certificate Copy of Coop Act -1861/Multi-State Coop Act - 2002 in case of cooperatives.
  • NOC & Copy of License from Manufacturer (mandatory for repackers and relabellers only)
  • Food Safety Management System Plan or Certificate ( if any)
  • In the case of milk and milk products processing facilities, provide the source of milk or the milk procurement plan, including the locations of milk collection centers, etc.(wherever applicable)
  • Provide the source of raw materials for meat and meat processing plants (wherever applicable)
  • Provide Reports of pesticide residues in water from facilities that produce packaged drinking water, Carbonated water, or mineral water from an accredited public health laboratory
  • Wherever applicable, include information about the product's distributor in the recall plan.
  • NOC from the local authority/ municipality
  • Form IX: Nomination of Persons by a Company alongwith the Board Resolution
  • Provide a certificate provided by the Ministry of Tourism (HRACC). (Mandatory for Hotel Only)
  • Supporting documentary proof for Turnover or self-declaration of the number of vehicles. (Mandatory for Transporter Only)
  • Declaration form (In Case of Delhi & Himachal Pradesh)

Inspection Process Explained

Following are the factors that an inspecting authority will check:

  • Sanitation and hygiene are maintained at the premises. 
  • Storage facilities are available at the premises.
  • The pest control practices by the entrepreneur. 
  • Equipment is being duly sanitized.
  • The food handling procedures at the premises.
  • Records are being maintained.
  • The hygiene standards of the employees. 

The consequences of not following the above-mentioned standards can result in rejection, notice for rectification, or temporary suspension. 

Validity and Renewal - FSSAI State License

The FSSAI State Licence is valid for 1 to 5 years, depending on the duration chosen by the food business operator at the time of applying.

It is important to note that if the entrepreneur wishes to renew their license, they must apply for renewal at least 30 days before the expiration date. Any late renewal application will be fined  ₹100 per day. Additionally, running the food business after the expiration date without applying for renewal will be considered illegal, and the entrepreneur will have to apply for a fresh registration to restart the business. 

Furthermore, a food business operator having a valid certificate from an accredited food authority agency or an accredited food safety auditor will not be required to be inspected before renewal of the license.
